A. Not for every estate. It will depend on what estate planning documents were done (such as a revocable trust or a transfer on death deed), how the property and assets were owned, and whether beneficiary designations were set up.

Estate litigation is when someone files a formal lawsuit or objection to an estate. This might be to try to throw out estate planning documents or to look into how an estate was handled by a personal representative or a trustee.
